Boulder judge has added the Colorado Oil and Gas Conservation Commission (COGCC) as a party to a lawsuit against a voter-approved ban on hydraulic fracturing in Longmont.
The ruling makes two lawsuits that the state is involved in against the City of Longmont. The first suit, filed in July 2012, took aim at a City Council-approved set of oil and gas regulations that barred drilling in residential neighborhoods.
State officials have argued that the city’s ban on drilling in neighborhoods usurps the state’s authority to oversee oil and gas operations in Colorado.
